Terms & Conditions
Yacht Charter Agreement — Using this website and booking our services implies full acceptance of the following contractual clauses.

Rates & Costs
Charter rates are VAT-inclusive. All costs related to insurance, onboard equipment, and regular maintenance and cleaning of the vessel are included.

Extra Costs
In addition to the charter fee, the client is responsible for all fuel costs based on the itineraries shown on the website, moorings at ports other than the home base, and extra food and beverages (bottles, champagne, etc.).

Fuel
For any itinerary changes requested by the client, the company reserves the right to charge the difference in fuel cost based on a consumption rate of 83.9 L/h per engine.

Safety & Prohibitions
For the safety of navigation, smoking is not permitted in any indoor or outdoor area. It is expressly forbidden to bring any animals onboard without prior written authorisation from the operating company.

Owner's Liability
The operating company accepts no liability for delays and/or disruptions to the planned cruise programme due to adverse weather conditions affecting navigation safety; in such cases the contract remains valid. Should the vessel be rendered unusable due to hidden defects or unforeseeable malfunctions, the company undertakes to provide a comparable vessel or reimburse the unused portion.

Health & Conduct
Clients must follow safety rules and inform the crew before departure of any physical or mental condition. The client indemnifies Naomi Charter SRLS and onboard staff from any consequences arising from failure to disclose such information.

Withdrawal & Early Termination
Should the client choose to end the cruise earlier than agreed, the operating company shall not be obliged to provide any refund.

Deposits & Cancellation Policy
The initial 30% deposit, paid at the time of booking, is non-refundable in the event of cancellation by the client. The second deposit, equal to 50% of the remaining balance and due within 7 days before the charter, becomes non-refundable from that point onward. In the event of cancellation within the 7 days preceding the charter date, the deposits already paid (initial 30% and any 50% of the balance) shall be definitively retained by the operating company.

Violations
If the client or their guests breach any applicable laws, the contract will be immediately and automatically terminated without prejudice to the rights of the operating company.

Weather Conditions
Navigation is subject to sea and weather conditions. The final decision rests solely with the Captain. In the event of adverse weather that compromises safety, an alternative date will be offered or, if not possible, a voucher of equivalent value. No refund is due if the client withdraws when conditions have been declared suitable by the Captain.

Joint Liability
The Charterer assumes full responsibility for the conduct of their guests and is jointly liable with them for any damage caused to the vessel or penalties incurred due to improper behaviour.

Jurisdiction
Any dispute arising from this contract shall be subject to the exclusive jurisdiction of the Court of Tempio Pausania.
